General Terms and Conditions

The following definitions apply in these terms and conditions:
Supplementary agreement: an agreement whereby a consumer acquires products in connection with a distance contract, and these products are supplied by the trader or a third party based on an arrangement between that third party and the trader;
Withdrawal period: the period within which the consumer may exercise the right of withdrawal;
Consumer: a natural person not acting for purposes relating to his trade, business or profession;
Day: calendar day;
Extended duration transaction: a distance contract relating to a series of products, where obligations are spread over time;
Durable medium: any tool – including email – that allows storage of information for future reference without alteration;
Right of withdrawal: the consumer’s right to cancel a distance contract within the withdrawal period in accordance with Directive 2011/83/EU;
Trader: MORRIGAN B.V., offering products to consumers at a distance;
Distance contract: a contract concluded within an organized system for distance selling without simultaneous physical presence;
Model withdrawal form: the European standard withdrawal form as included in Appendix I;
Technique for distance communication: any means enabling contract conclusion without physical presence.

These terms apply to every offer made by MORRIGAN B.V. and to every distance contract concluded between MORRIGAN and a consumer.
Prior to the conclusion of the contract, these terms shall be made available in a durable medium.
Where additional product-specific conditions apply, the consumer may always invoke the provision most favorable to them.

All offers are non-binding unless explicitly stated otherwise.
The offer contains a complete and accurate description of the products.
Due to the handmade and natural character of MORRIGAN products, variations in color, texture, size, and finish may occur and shall not be considered defects.Obvious errors or mistakes in the offer do not bind MORRIGAN.

The contract is concluded now that the consumer accepts the offer and fulfills the stated conditions.
MORRIGAN shall confirm receipt of acceptance electronically without delay.
MORRIGAN reserves the right to refuse an order or impose special conditions if justified by objective reasons.

Upon delivery of products:
The consumer has the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which the consumer, or a third party designated by the consumer, acquires physical possession of the goods.
Where multiple goods are ordered, the withdrawal period starts upon receipt of the last product.
If the consumer has not been informed of the right of withdrawal, the withdrawal period shall expire 12 months after the end of the original withdrawal period.

During the withdrawal period, the consumer shall handle the product and packaging with care.
The consumer may only use the product to the extent necessary to establish its nature and characteristics, as would be allowed in a physical store.
The consumer is liable for any diminished value resulting from handling beyond what is necessary.

The consumer shall notify MORRIGAN of the withdrawal within the withdrawal period by means of the model form or another clear statement.
The consumer shall return the goods within 14 days after notification.
The consumer bears the direct costs of returning the goods, unless otherwise agreed.
Returned products must be complete and, where reasonably possible, in original condition and packaging.

MORRIGAN shall reimburse all payments received, including standard delivery costs, within 14 days after being informed of the withdrawal.
Reimbursement may be withheld until the goods have been received or proof of return is provided.
Refunds shall be made using the same payment method unless otherwise agreed.

The right of withdrawal may be excluded for:
Products made to the consumer’s specifications or clearly personalized
Products that deteriorate rapidly or have a limited shelf life
Sealed goods not suitable for return for health or hygiene reasons once opened
Products that are inseparably mixed with other goods

Prices shall not increase during the validity period stated in the offer, except for changes in VAT.
All prices include VAT unless otherwise stated.
Obvious pricing errors are not binding.

MORRIGAN guarantees that products conform to the contract, the specifications in the offer, and reasonable requirements of reliability and usability.
Consumers retain all statutory rights under applicable EU consumer law.
Any additional guarantee does not affect these statutory rights.

MORRIGAN shall execute orders with due care.
Delivery shall take place within a reasonable period, and at the latest within 30 days unless otherwise agreed.
If delivery is delayed, the consumer shall be informed and may terminate the contract free of charge.
Risk of loss or damage transfers to the consumer upon delivery.
Any applicable shipping and delivery charges will be displayed during the checkout process prior to the completion of the order. By placing an order, the customer acknowledges and accepts the applicable delivery costs.

The consumer may terminate agreements of indefinite duration at any time with a notice period not exceeding one month.
Fixed-term agreements shall not be automatically renewed unless permitted by law.

Payments must be made within 14 days unless otherwise agreed.
Advance payments shall not exceed 50% for consumer transactions.
In case of late payment, statutory interest and reasonable collection costs may be charged.

Complaints must be submitted without undue delay and in full detail.
MORRIGAN shall respond within 14 days.
If a complaint requires longer processing, an acknowledgment will be sent within 14 days with an indication of the response time.

MORRIGAN shall not be liable for failure to perform obligations due to force majeure.
Force majeure includes, but is not limited to:
Natural disasters
Supply chain disruptions
Transport delays
Government measures or restrictions
Strikes, pandemics, or unforeseen external events
During force majeure, obligations shall be suspended.
If the situation lasts longer than 60 days, either party may terminate the contract.

All agreements are governed by Dutch law.
Consumers may also rely on mandatory provisions of their country of residence within the EU.

Any additional or deviating provisions shall not be detrimental to the consumer and must be recorded in a durable medium.

All intellectual property rights relating to the MORRIGAN website, products, designs, trademarks, trade names, logos, photographs, images, texts, catalogs, marketing materials, and other content are owned by or licensed to MORRIGAN and are protected by applicable intellectual property laws.
Nothing in these Terms & Conditions shall be construed as granting any license or right to use any intellectual property rights of MORRIGAN without the prior written consent of MORRIGAN.
Customers, visitors, distributors, and business partners are not permitted to copy, reproduce, distribute, modify, publish, display, sell, exploit, or otherwise use any content, designs, product concepts, photographs, trademarks, or other intellectual property of MORRIGAN for commercial purposes without prior written authorization.
Any unauthorized use of MORRIGAN's intellectual property rights may result in legal action and claims for damages to the fullest extent permitted by applicable law.
The purchase of a MORRIGAN product does not transfer any intellectual property rights relating to the product design, branding, or associated materials to the customer.

21.1 General Product Safety
MORRIGAN ensures that all products are manufactured and supplied in accordance with applicable European safety standards and regulations, including but not limited to CE requirements where applicable.
Due to the artisanal and natural nature of the products, minor variations do not affect product safety and shall not be considered defects.
21.2 Use of Products
The consumer is responsible for using the products in accordance with their intended purpose and all the instructions provided.
MORRIGAN shall not be liable for damage resulting from:
Improper use or misuse
Use contrary to safety instructions
Modification or alteration of the product
Use of incompatible accessories or components
21.3 Specific Safety – Lamps (Electrical Products)
All lamps are intended for indoor use unless explicitly stated otherwise.The consumer must ensure:
Installation is performed correctly and, where required, by a qualified professional
Only compatible bulbs and voltage are used
The product is not exposed to moisture unless specified
MORRIGAN shall not be liable for any damage, loss, injury, or expense resulting from improper installation, the use of unsuitable electrical components, exceeding the recommended wattage, failure to follow safety instructions, incorrect assembly, misuse, negligence, modification, inadequate maintenance, or use of a product outside its intended purpose, specifications, or recommended conditions.
Customers are responsible for ensuring that products are installed, handled, maintained, and used in accordance with all instructions, safety guidelines, and applicable regulations.
Nothing in this clause shall exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
21.4 Specific Safety – Candles
Candles must be used in accordance with standard fire safety practices.The consumer must ensure:
Candles are never left unattended while burning
Candles are placed on stable, heat-resistant surfaces
Sufficient distance is maintained from flammable materials
Candles are kept out of reach of children and pets
MORRIGAN shall not be liable for damages arising from the improper use, storage, or supervision of candles and other products requiring special safety precautions.
21.5 Limitation of Liability
To the extent permitted by law, MORRIGAN’s liability is limited to the purchase value of the product.MORRIGAN shall not be liable for:
Indirect or consequential damage
Loss of profit or business
Damage caused by improper use or external factors
Nothing in these terms shall exclude or limit liability where such limitation is not permitted under applicable law, including liability for death or personal injury caused by negligence.
21.6 Consumer Responsibility & Risk Acknowledgement
By purchasing and using MORRIGAN products, the consumer acknowledges the inherent characteristics and risks associated with natural materials, candles, and electrical lighting products. -
